Please read these General Terms and Conditions carefully before using our Services. We strongly encourage you to review them in full: they contain important information about your rights and obligations.
1. Agreement
These Terms & Conditions (the “Terms”) form a legally binding agreement between you and Optimalio Ltd (Reg. No 124074), trading as Mundo-FX, with its registered address at Trust Company Complex, Ajeltake Road, Ajeltake Island, Majuro, Republic of the Marshall Islands MH 96960. They govern your use of our website, client portal, trading platforms, tools, resources, features and related services (together, the “Services”). These provisions are legally binding, transparent and enforceable.
By registering for an account or using the Services, you confirm that you have read, understood and agree to these Terms, our Privacy Policy, our Risk Disclosure Policy and our Cancellation & Withdrawal Policy. You may use the Services only if you fully and unconditionally accept these Terms; if you do not agree, you must stop using the Services immediately. To become a registered member, you must read and understand these Terms before completing the registration process.
2. Definitions
In these Terms, our customers may be referred to as “Customers”, “Users”, “Members”, “Account Holders”, “Traders”, or “he”, “she”, “them” or “it”, in the singular or plural. Similarly, Mundo-FX may be referred to as “Mundo-FX”, the “Broker”, the “Brokerage Service Provider”, the “Trading Platform”, the “Trading Intermediary”, “we” or “us”.
3. Eligibility
To use the Services you must:
- Be at least 18 years old, or the age of legal majority in your jurisdiction if higher.
- Have full legal capacity to enter into this agreement.
- Not be a resident of any country or territory where the Services are restricted or where their use would breach local law or regulation.
- Not be a politically exposed person unless you have disclosed this and been approved by us.
- Provide accurate, complete and up-to-date information during registration and keep it updated.
We may refuse to open an account, or close an existing one, at our discretion and in line with our legal obligations.
4. Restricted Jurisdictions
Mundo-FX operates in compliance with the laws of various jurisdictions. In some regions, legal restrictions may prohibit access to our brokerage services. We are unable to provide services where this is legally restricted, and we are not obliged to continue providing them if the legal conditions change after you register. If you access our platform from a restricted region, including through a VPN or any other tool used to get around restrictions, you do so at your own risk and accept full responsibility for any consequences.
5. Account Opening and Verification
You must complete our identity-verification process before depositing above initial limits, trading or withdrawing. We may request additional documents at any time to meet our AML, KYC and sanctions obligations. Failure to provide requested documents may lead to restrictions on your account, including the suspension of trading and withdrawals.
6. Account Security
You are responsible for keeping your login credentials confidential and for all activity carried out through your account. Enable two-factor authentication where available and notify us immediately at the support address if you suspect unauthorised access. We will never ask for your password by email, phone or chat. Although we provide password-recovery options, we cannot guarantee the security of your account if you disclose your login credentials; safeguarding your account information is your responsibility.
7. Services and Execution
We provide an execution-only service for CFDs and other OTC products on forex, cryptocurrencies, indices, commodities and stocks. We act as principal and counterparty to your trades. We do not provide investment advice. Orders are executed in accordance with the conditions displayed in the platform at the time of execution. Prices quoted may change between the time you place an order and the time it is executed, and we may re-quote or reject orders in abnormal market conditions.
8. Information and No Advice
The content on our website is created by professionals and is provided for information purposes only. It must not be interpreted as financial or investment advice, and any reliance on it as investment guidance is entirely at your own risk. We reserve the right to restrict or remove access to any content when required by law.
9. Margin, Leverage and Stop-Out
You must maintain sufficient margin to support your open positions at all times. Maximum leverage varies by account type, instrument and jurisdiction, and we may change margin requirements, including without notice during volatile markets. If your margin level falls to the stop-out level stated for your account, we may close some or all of your positions without further notice. Where negative-balance protection applies to your account, we will not seek to recover a negative balance resulting from trading losses, except where it arises from abusive trading or breach of these Terms.
10. Fees and Charges
Our costs include spreads, commissions where applicable, overnight swap or financing charges, currency-conversion fees and any inactivity fees stated in the client portal. All current fees are published in the platform and on our website. Your bank or payment provider may apply their own charges. We may change our fees by giving you notice as described in section 22.
11. Deposits and Withdrawals
Deposits must come from accounts in your own name; third-party payments are not accepted. Withdrawals are processed in accordance with our Cancellation & Withdrawal Policy and are generally returned to the original funding source. We may delay or refuse a withdrawal where required by law, where verification is incomplete, or where we reasonably suspect fraud, money laundering or a breach of these Terms.
12. Bonuses and Promotions
Any promotion or bonus we offer is subject to its own published terms, which form part of this agreement. Bonus funds are not client money until the stated conditions are met, and may be withdrawn if the conditions are not satisfied or if the promotion is abused.
13. Prohibited Activities
You must not use the Services to:
- Exploit pricing errors, latency or delays in price feeds (“latency arbitrage”).
- Engage in market manipulation, collusion or coordinated trading between accounts.
- Use software designed to gain an unfair advantage or to interfere with our systems.
- Launder money, finance terrorism or evade sanctions.
- Open multiple accounts to abuse promotions or hedge between accounts.
- Provide false or misleading information.
If we reasonably believe you have engaged in prohibited activity, we may cancel or adjust the related trades, withhold profits, suspend or close your account and report the matter to the relevant authorities.
14. Manifest Errors
If a trade is executed at a price that is clearly wrong because of a system error, incorrect quote or other manifest error, we may void the trade or adjust it to the correct market price at the time, acting reasonably and in good faith. We will notify you as soon as practicable.
15. Intellectual Property
All content, resources, tools and features available through our website and platforms, including text, graphics, logos, software and data, are the exclusive property of, or licensed to, Mundo-FX and are protected by intellectual-property laws. You may use them only for your personal, non-commercial use of the Services. Any unauthorised reproduction, distribution, sale or use of any material without our explicit permission is strictly prohibited, and we may take legal action in the event of an infringement. Market data displayed through third-party providers remains the property of those providers.
16. Third-Party Resources
To enhance our services, Mundo-FX works with third-party partners. You may choose to use third-party resources, but doing so is entirely at your own discretion, and Mundo-FX is not responsible for any losses, fraud or theft resulting from such interactions.
17. Risk Awareness and No Guarantee
Trading, including CFD trading, carries inherent risks. Risk-management strategies can help limit potential losses but cannot eliminate risk entirely, and we strongly encourage you to apply sound risk-management practices. Mundo-FX does not guarantee any profit from trading activities and is not responsible for trading losses incurred by users. Please read our Risk Disclosure Policy.
18. Limitation of Liability
Our liability is strictly limited to the services offered through our trading platform, and our services must not be considered financial or investment advice. Both Mundo-FX and its users are responsible for their own actions, and we do not accept liability for events beyond our control. To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit or opportunity, or losses arising from market movements, your trading decisions, the use of automated tools, failures of systems or communications outside our reasonable control, or your breach of these Terms. Nothing in these Terms excludes liability that cannot be excluded by law, including liability for fraud or for our gross negligence.
19. Indemnity
You agree to indemnify us against losses, costs and expenses we incur as a result of your breach of these Terms, your violation of any law, or your fraudulent or negligent use of the Services.
20. Force Majeure
We are not responsible for any failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, exchange or market closures, extreme market conditions, power or internet failures and cyber-attacks. In such events we may take reasonable steps, including closing positions, changing margin requirements or suspending trading.
21. Suspension and Termination
Our Services are available exclusively to registered members. Unauthorised access to the Services is strictly prohibited, and any unauthorised use may result in the suspension or termination of the account concerned.
You may close your account at any time by contacting support, provided you have no open positions and no outstanding obligations. We may suspend or terminate your account with notice, or immediately where required by law, where you breach these Terms, or where we suspect fraudulent or abusive activity. On termination we will close any open positions at prevailing prices and return your remaining balance after deducting any amounts you owe us.
22. Changes to These Terms
We may amend, supplement or remove provisions of these Terms to reflect changes in law, regulation, our services or our business. We will notify you of material changes by email or through the client portal, normally at least 10 business days before they take effect, unless the change is required sooner by law. Continuing to use the Services after the effective date means you accept the updated Terms.
23. Complaints
If you are unhappy with our service, email support@mundo-fx.pro with the subject “Complaint”, your account number and a description of the issue. We will acknowledge your complaint within 5 business days and aim to give a final response within 30 days.
24. Governing Law
These Terms are governed by the laws of the Republic of the Marshall Islands, and the courts of the Marshall Islands have jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence.
25. General
If any provision of these Terms is found to be invalid, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. You may not transfer your rights under these Terms without our written consent. If these Terms are translated, the English version prevails.
By using Mundo-FX services, you acknowledge and accept these Terms & Conditions.
